Standing Up for Collective Bargaining: OSSTF/FEESO Petition on the Notwithstanding Clause
In November 2025, OSSTF/FEESO launched a province-wide petition campaign calling on the Government of Ontario to renounce the misuse of the Notwithstanding Clause (Section 33 of the Canadian Charter of Rights and Freedoms) in labour disputes.
This initiative, outlined in D/BU #071/2025–2026, represents a proactive step to defend workers’ rights, democratic accountability, and the integrity of free collective bargaining ahead of the next round of negotiations.
Building Awareness and Member Engagement
From its launch, local Bargaining Units and Districts were encouraged to:
- Share the petition widely with members and allies
- Raise awareness about the impact of Section 33 in labour relations
- Engage members in conversations about protecting Charter rights
This coordinated effort reflects OSSTF/FEESO’s commitment to ensuring members are informed, mobilized, and ready to advocate for strong, fair bargaining protections.
Support Across the Province
The petition has seen strong support. As of May 2026, more than 2,250 individuals signed the petition, demonstrating broad concern about the implications of using Section 33 in labour disputes.
Bringing the Issue to Queen’s Park
A key milestone was reached between May 6 and May 14, 2026, when fifteen (15) Members of Provincial Parliament (MPPs)–7 NDP, 6 Liberal, and 2 Green Party MPPs-signed and formally introduced the OSSTF/FEESO petition during House proceedings.
This ensured that OSSTF/FEESO members’ voices were heard directly at Queen’s Park and brought the issue of Charter rights and the importance of free and fair collective bargaining before elected officials.
Why This Matters
OSSTF/FEESO’s position is clear. Bargaining and labour disputes must be resolved through good-faith negotiation, not extraordinary legislative powers. The freedom of association and collective bargaining are fundamental to unionized workers. The petition campaign was an important step in reinforcing that workers’ rights must be respected and protected.
Continuing the Momentum
The petition campaign marks an important step, but the work continues.
OSSTF/FEESO will:
- Keep advocating for the protection of collective bargaining rights.
- Engage members in ongoing organizing and mobilization actions as part of its bargaining preparations.
- Hold government accountable for respecting Charter protections.
Together, members have sent a strong message: workers’ rights are not optional, and they must not be overridden.
